The plaintiffs, DWF Maas and Falcon Digital, contend that BitGo violated contractual obligations governing the sale of Falcon Finance (FF) and ESPORTS tokens. According to the claims, these digital assets were subject to a three-month lock-up period and subsequent vesting conditions designed to prevent premature market entry. The lawsuit asserts that BitGo’s unauthorized disposal of these tokens exerted downward pressure on asset prices, directly diminishing the value of the plaintiffs' remaining holdings.
While the claimants are seeking $141 million in damages, these figures represent the plaintiffs' own valuation of losses rather than an independently verified court judgment. BitGo has declined to comment on the allegations, and no public court ruling has yet established liability. The dispute highlights the complexities of over-the-counter (OTC) transactions, where negotiated trading restrictions are intended to stabilize market liquidity. As the litigation proceeds in the High Court, the court will be tasked with examining the specific contractual language and the timing of the alleged transactions to determine if a breach occurred.
