Polymarket lobbies European regulators for financial status

Polymarket is aggressively lobbying European and UK regulators to reclassify its prediction contracts as financial instruments rather than gambling products. The New York-based platform, currently seeking a valuation exceeding $20 billion, aims to move away from national betting laws toward the broader Markets in Financial Instruments Directive framework.

The company has initiated high-level meetings with the European Securities and Markets Authority and the UK Financial Conduct Authority to secure a more favorable licensing path. In June, legal representatives and lobbyists met with ESMA chair Verena Ross and FCA chief executive Nikhil Rathi to argue that their contracts function as derivatives. This push for legitimacy arrives as the platform faces significant friction: French and Czech authorities have already ordered internet service providers to restrict access, citing the platform’s status as an unauthorized gambling service.

Regulators remain skeptical of this pivot. ESMA has signaled that even if contracts meet the definition of financial instruments, they could still fall under existing bans on speculative binary options. The FCA maintains a similarly rigid stance, separating markets by event type; while financial or climate-based outcomes might fall under their purview, political and sports betting remain firmly under the Gambling Commission’s jurisdiction. Despite these hurdles, Polymarket continues to scale its operations, bolstered by massive capital interest and recent investments from firms like the Intercontinental Exchange.
