The proposed legislation, H.R. 3633, aims to delineate the regulatory boundaries between the Securities and Exchange Commission and the Commodity Futures Trading Commission. Grayscale contends that current reliance on fluctuating agency guidance and enforcement actions stifles the development of exchange-traded products, creating an unstable environment for investors. Treasury Secretary Scott Bessent has amplified this pressure, publicly calling for immediate action and accusing certain Senate Democrats of stalling the bill to satisfy crypto critics.

Progress remains hampered by a 60-vote threshold and unresolved debates regarding ethics restrictions for federal officials. A compromise proposed by Senators Thom Tillis and Ruben Gallego, which would empower state authorities to police federal officials' digital asset activities, is currently being tested for bipartisan viability. With the House having already passed its version of the bill in July 2025, the Senate faces a narrow window to reconcile these differences. Without a vote before the recess, the legislation risks being sidelined by competing budget and policy deadlines, further delaying the regulatory clarity industry stakeholders claim is vital for American competitiveness.
