The lawsuit claims the company ignores critical safeguards, including the state’s 21-year-old minimum age requirement for sports betting participants.

The state’s filing in Manhattan court seeks to halt Polymarket’s current operations, demanding restitution for users and the forfeiture of all gains identified as illicit. Officials argue that by bypassing the New York State Gaming Commission, the platform exposes residents to financial risks without the regulatory protections mandated for approved operators. Governor Kathy Hochul emphasized that these gaps leave younger, more vulnerable users susceptible to the dangers of problem gambling.

This legal challenge places Polymarket alongside other high-profile firms like Kalshi, Coinbase, and Gemini Titan, all of which face similar scrutiny from James. While the companies often assert that federal Commodity Futures Trading Commission oversight preempts state rules, New York officials maintain that federal derivatives frameworks do not strip states of their authority to regulate wagering within their borders. As federal appeals courts remain divided on the reach of state gambling laws, the industry awaits a potential Supreme Court intervention to resolve whether federal registration grants total immunity from state-level licensing requirements.
