The upcoming cloture vote requires 60 senators to advance H.R. 3633, a threshold that remains elusive without significant Democratic cooperation. Scott, speaking at the Wyoming Blockchain Symposium, argued that Warren and her allies are repeatedly shifting negotiation goalposts for political leverage. His comments have placed the Massachusetts Democrat at the center of a legislative impasse over the most comprehensive digital asset framework proposed in Congress to date.

While the House passed its version in July 2025 with bipartisan support, the Senate remains divided. Key sticking points include stringent financial-crime controls, DeFi developer protections, and proposed restrictions on crypto activities involving elected officials. Senator Ruben Gallego, a key Democratic voice, has warned that forcing a floor vote prematurely could jeopardize the delicate bipartisan consensus required for long-term success. Meanwhile, industry analysts remain skeptical about the bill's momentum, with prediction markets currently assigning only a 20% probability of the legislation becoming law before the end of 2026.
