The bipartisan measure, which cleared the House with a 294–134 vote, aims to delineate the regulatory boundaries between the Securities and Exchange Commission and the Commodity Futures Trading Commission. Proponents argue this clarity is essential for exchanges and developers, yet the bill remains stuck in the Senate. Majority Leader John Thune has prioritized other legislative items, pushing the possibility of a floor vote to the final week of the current session at best.

Securing passage requires at least eight Democratic votes, a threshold that remains elusive due to ongoing disputes over enforcement authority. Critics, including New York Attorney General Letitia James, contend the current draft could undermine state-level oversight and weaken efforts to combat fraud. Furthermore, negotiations are currently snagged on restrictions regarding elected officials' digital asset interests. While industry giants like Coinbase and Ripple continue to lobby for the bill, the lack of immediate action extends a period of regulatory uncertainty. If the Senate fails to reconcile its version with the House text before the current Congress expires, the debate over crypto market structure could be delayed until 2027.
