Lawmakers are examining whether event-based contracts on decentralized platforms fall under the jurisdiction of the Commodity Futures Trading Commission or if they effectively bypass state-level gambling prohibitions. Representatives from the American Gaming Association and the Indian Gaming Association argue that these products mirror traditional sports wagering, necessitating a legislative intervention to protect market integrity and consumer interests. Conversely, supporters of these markets contend that the CFTC already possesses sufficient authority under the Dodd-Frank Act to block any contracts deemed contrary to the public interest, rendering new restrictive legislation unnecessary.

Legal tensions have intensified following a ruling by Judge Analisa Torres, which determined that New York gambling laws can apply to Kalshi’s event contracts. This decision undermines the argument that federal derivatives status grants total immunity from state regulations. As these legal battles unfold, decentralized protocols like Hyperliquid are simultaneously advancing technical frameworks for permissionless outcome markets. While Hyperliquid’s HIP-4 system seeks to automate market creation through validator-approved templates, the upcoming House hearing remains focused on the broader regulatory question: whether sports-linked derivatives can coexist with established gambling laws or if they require an outright ban on federally regulated exchanges.
